Three more H1N1 deaths bring toll to 67

PUTRAJAYA, Aug 18 — The Ministry of Health today reported another three deaths as a result of the H1N1 pandemic, bringing the total number of dead so far to 67. According to the ministry website, 276 patients remain under close observation, with 36 being treated in intensive care units (ICU) nationwide....

I don't understand this. They will only declare a health emergency/curfew after 0.4%/4225 confirmed cases? But didn't it reach 4225 confirmed cases already?
